Ex- Federal Bureau of Investigation Staff Member Alleges Unlawful Firing Due to LGBTQ+ Symbol Display

A veteran FBI intelligence specialist has brought legal action claiming he was let go because of having a Pride flag within his workstation.

As per the plaintiff, that served for the FBI over a decade and a half, his dismissal earlier this year was “illegal and discriminatory”.

Court Action Claims First Amendment Violations

The lawsuit argues that the FBI breached the plaintiff’s constitutional rights and engaged in punitive action against him because of expressing protected expression.

The plaintiff is asking for a court order to restore his employment within the agency.

The 18-page complaint, filed in the US district court in Washington, D.C., alleges that the employee was terminated from the Quantico facility last month because of earlier showing the Pride symbol at his workstation.

As stated in the complaint, the rainbow symbol was awarded to the employee in recognition of his contributions to promote the FBI’s equality efforts.

“From a young age, my goal has been to serve the United States and protect public safety alongside the skilled and devoted individuals of the FBI,” remarked the former employee.

He continued, I exhibited that Pride flag – which in 2021 flew in front of a federal building – not as a political statement, but rather as an emblem of diversity, togetherness and fair treatment.

These principles that once made a robust FBI. Currently it stands as where employees like me face discrimination. I think I was dismissed not because of who I am, but what I am: a homosexual man,” he concluded.

Unexpected Dismissal Just ahead of Graduation

Recently, the employee was enrolled in the FBI special agent training academy at the FBI facility, until his “abrupt dismissal only weeks prior to finishing”.

The lawsuit additionally states that at some point after the 2017 inauguration, an colleague expressed an issue to the overseeing official regarding the display of the LGBTQ+ symbol.

As a precaution, the employee requested that the top lawyer for the local bureau assess if the display of the symbol was allowed,” the filing noted.

Notice of Termination

Legal Comment

In a release released this week, his attorney the attorney said, “This administration’s illegal termination forms part of an extensive initiative to rid government departments of employees that possess divergent opinions, or belong to minority populations, or individuals that oppose prejudice.

This battle goes beyond his situation, but about securing the entitlements and freedoms of all federal employees.”

Department Response

The FBI declined to comment regarding the case.

Comparable Lawsuits

This legal action comes after a separate case filed in September by previous high-level bureau employees who alleged they’d been wrongfully terminated.

They stated that Patel said he had been instructed by the president’s office to terminate any employee involved in an inquiry regarding the former president.

Meanwhile, the agency dismissed a nearly three-decade veteran recently subsequent to Patel was said to be angered by reports that the agency head flown on an official aircraft to attend a wrestling event where his girlfriend sang the national anthem.
